This Smart Home and Surveillance Disclaimer governs the installation, configuration, integration, and support of smart home systems, security systems, surveillance cameras, audio and video systems, networking components, automation platforms, and related technologies provided by Shack Solutions, a sole proprietorship operating in Ontario, Canada.

Shack Solutions provides installation and configuration services for equipment manufactured and supplied by third-party brands. Shack Solutions does not manufacture hardware or software and does not control third-party firmware, cloud services, data storage systems, mobile applications, artificial intelligence features, facial recognition tools, or remote access platforms. All such systems are subject to the terms, policies, limitations, and technical constraints of their respective manufacturers and service providers.

The client acknowledges that no smart home, automation, or surveillance system can guarantee prevention of theft, intrusion, vandalism, fire, water damage, cyber intrusion, personal injury, or property loss. These systems are tools designed to assist in monitoring and automation but are not fail-safe security solutions. System effectiveness depends on numerous variables outside the control of Shack Solutions, including internet reliability, electrical supply, router configuration, signal strength, environmental interference, device compatibility, user configuration, and ongoing software updates issued by manufacturers.

Shack Solutions is not responsible for service interruptions caused by internet outages, modem or router failure, power loss, cloud service downtime, cybersecurity breaches, password mismanagement, firmware updates, manufacturer discontinuation of service, or incompatibility arising from third-party updates. The client understands that many smart home devices rely on cloud-based platforms that may change, restrict access, introduce subscription fees, or discontinue features without notice. Shack Solutions shall not be liable for such changes.

The client is solely responsible for compliance with all applicable federal, provincial, and municipal privacy laws concerning audio and video recording on private or commercial property. In Ontario and throughout Canada, privacy obligations may arise when recording individuals without consent, particularly in rental properties, shared spaces, workplaces, or areas where individuals have a reasonable expectation of privacy. Shack Solutions does not provide legal advice regarding surveillance compliance. The client assumes full responsibility for ensuring that cameras and recording devices are installed and used lawfully.

If the client installs cameras in rental properties, condominiums, or properties subject to homeowner association rules, the client is responsible for ensuring compliance with applicable bylaws and regulations. Shack Solutions shall not be responsible for fines, complaints, or legal claims arising from improper camera placement, audio recording features, or data retention practices.

The client acknowledges that cybersecurity risks are inherent in internet-connected systems. While Shack Solutions may assist with initial configuration, including password setup and network integration, ongoing security of the system depends on the client maintaining strong passwords, updating firmware, protecting Wi-Fi credentials, and following manufacturer guidelines. Shack Solutions is not liable for unauthorized access resulting from client negligence, weak passwords, unsecured networks, or failure to maintain updates.

Data generated by surveillance or smart devices may be stored locally, on third-party cloud servers, or on hybrid systems. Shack Solutions does not store or control client surveillance data unless expressly agreed in writing. The client is responsible for reviewing and understanding the data storage policies of device manufacturers and cloud service providers.

Smart home systems often require integration across multiple brands and protocols. While Shack Solutions exercises professional care in system configuration, interoperability limitations may exist between devices. Future updates by manufacturers may alter compatibility. Shack Solutions does not guarantee perpetual compatibility between devices from different manufacturers.

Environmental factors such as temperature fluctuations, moisture, dust, construction vibration, landscaping growth, structural movement, and wildlife may affect outdoor camera and sensor performance. Routine maintenance is the responsibility of the client unless a separate maintenance agreement is in place.

Shack Solutions shall not be liable for indirect, incidental, consequential, or punitive damages arising from system malfunction, false alarms, missed alerts, delayed notifications, or failure of monitoring services. The client agrees that total liability, if any, shall not exceed the amount paid for installation services related to the specific system at issue.

By approving installation of smart home or surveillance systems, the client acknowledges and accepts the limitations described in this Disclaimer.
